This JobCal PRO Limited Use License Agreement ("License") governs your use, installation, copying, and redistribution of the JobCal PRO Android application ("JobCal PRO," "Software," or "Application") provided by A&W Pressure Washing and Cleaning ("A&W," "we," "us," or "Licensor").

By downloading, installing, accessing, copying, or using JobCal PRO, you acknowledge that you have read, understood, and agree to be legally bound by the terms of this License. If you do not agree to these terms, you must not download, install, copy, or use the Software.

1. Software Description

JobCal PRO is an independently developed Android software application designed primarily to assist users with pressure-washing-related calculations, including, where applicable, chemical mixture calculations, surface-area calculations, and related operational calculations.

JobCal PRO is designed primarily to operate locally on the user's Android device without requiring an Internet connection for its core functionality.

Certain optional features may require an Internet connection, including:

• Submission of voluntary feedback;
• Checking for application updates; and
• Other optional online functionality that may be introduced in future versions.

The Software's core calculation functionality is not intended to require continuous Internet connectivity.

2. Ownership and Copyright

JobCal PRO is proprietary software owned by A&W Pressure Washing and Cleaning. All rights, title, and interest in and to the Software remain exclusively with A&W, except for third-party components that may be subject to their respective licenses. This License does not transfer ownership of JobCal PRO or any intellectual-property rights to you. The Software, including its source code, compiled code, application architecture, user interface, graphical assets, icons, logos, branding, text, documentation, calculation logic, algorithms, databases, original content, and other original materials, is protected by applicable intellectual-property and copyright laws. All rights not expressly granted by this License are reserved by A&W.

3. Limited License Grant

Subject to your continued compliance with this License, A&W grants you a limited, non-exclusive, royalty-free, revocable license to:

• Download JobCal PRO from an authorized distribution source;
• Install the original, unmodified Software on Android-compatible devices that you own or are authorized to use;
• Use JobCal PRO for its intended pressure-washing-related calculation purposes; and
• Make and retain reasonable backup copies of the original, unmodified APK solely for your own authorized use.

This is a license to use the Software, not a transfer of ownership. No other rights are granted.

4. Permitted Professional and Commercial Use

JobCal PRO may be used by individuals, contractors, employees, businesses, and other organizations in connection with legitimate pressure-washing and exterior-cleaning activities. Use of JobCal PRO in connection with a commercial pressure-washing business is permitted.

For example, a pressure-washing company may use JobCal PRO to calculate surface areas for customer projects, calculate or estimate chemical mixtures, assist employees or technicians with pressure-washing calculations, prepare for residential or commercial cleaning projects, and perform other legitimate pressure-washing-related calculations.

The fact that a user operates a commercial business or earns money from pressure-washing services does not, by itself, constitute prohibited commercial use of JobCal PRO. However, the Software itself may not be sold, licensed, rented, leased, sublicensed, or otherwise monetized except with express written permission from A&W.

5. Authorized Redistribution

You may freely provide a copy of the original, unmodified JobCal PRO APK to another person solely for the purpose of allowing that person to use JobCal PRO under this License, provided that: the APK has not been modified; no fee is charged specifically for the Software; no subscription, access fee, licensing fee, or other monetary consideration is required to obtain or use the Software; no proprietary notices, copyright notices, trademarks, logos, branding, or license information are removed or altered; the recipient receives the Software subject to this License; and the redistribution does not imply that the distributor created, owns, publishes, or officially represents JobCal PRO or A&W.

A&W reserves the right to discontinue authorized redistribution through third parties at any time. A&W's official website and designated distribution locations remain the preferred and authoritative sources for obtaining JobCal PRO and its official versions.

6. Prohibited Activities

Except where expressly authorized in writing by A&W, you may not:

6.1 Sell or Monetize the Software. Sell, charge for access to, charge a licensing fee for, rent, lease, sublicense JobCal PRO; require payment as a condition of receiving it; include it as a separately monetized component of a paid package; or otherwise commercially exploit the Software itself. This does not prohibit legitimate commercial pressure-washing activities performed using the Software as described in Section 4.

6.2 Modify the Software. Modify the APK, executable code, resources, calculation logic, functionality, UI, assets, branding, copyright notices, or license information; or create/distribute a modified version.

6.3 Reverse Engineer the Software. To the maximum extent permitted by law, reverse engineer, decompile, disassemble, attempt to derive source code, reconstruct proprietary algorithms, circumvent technical protections, extract proprietary assets for outside use, or use these techniques to build a competing product. Nothing here prohibits rights that cannot legally be waived.

6.4 Remove or Alter Attribution. Remove, obscure, alter, replace, or falsify copyright notices, branding, trademark notices, license information, or author attribution.

6.5 Claim Ownership or Authorship. Represent or imply that you created or own JobCal PRO, that it was developed by your company, that ownership was transferred to you, or that A&W endorses/sponsors/is affiliated with your modified or derivative product.

6.6 Create Competing Products. Use JobCal PRO or its proprietary materials to create, develop, market, distribute, or assist in developing a substantially similar competing application. This does not prohibit independently developed software based on general industry knowledge or publicly known concepts that doesn't improperly copy protected elements.

6.7 Unauthorized Distribution Platforms. Upload, publish, mirror, package, or distribute JobCal PRO through Google Play or other app marketplaces, third-party software stores, download repositories, piracy sites, modified-APK repositories, commercial bundles, or other channels implying official authorization, without prior written authorization from A&W.

7. Source Code

JobCal PRO is distributed in compiled Android application form. This License does not grant access to, or rights to distribute, the Software's source code. No source-code license is granted unless A&W expressly provides one in a separate written agreement.

8. Third-Party Components

JobCal PRO may contain or depend upon third-party software libraries, frameworks, APIs, services, or other components governed by their own licenses and terms. Nothing here supersedes or restricts rights granted under applicable third-party licenses.

9. Calculations and User Responsibility

JobCal PRO is provided as a calculation and planning aid. Its calculations must not be treated as a substitute for chemical manufacturer instructions, product labels, Safety Data Sheets (SDS), equipment specifications, applicable laws, industry safety practices, professional judgment, site-specific evaluation, or verification by a qualified person.

Users are solely responsible for independently verifying calculations and determining whether a particular chemical concentration, mixture, application method, cleaning procedure, equipment configuration, or other operation is appropriate — including verifying concentrations, dilution ratios, quantities, and measurements; confirming surface and chemical compatibility; following label and manufacturer requirements; using appropriate PPE; protecting people, animals, plants, and property; and complying with applicable federal, state, and local requirements.

Never rely solely on a calculation produced by JobCal PRO when handling or applying chemicals.

10. No Warranty

To the maximum extent permitted by applicable law, JobCal PRO is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express, implied, statutory, or otherwise. The user assumes responsibility for determining whether the Software is appropriate for their particular purpose.

11. Chemical and Property Disclaimer

A&W is not responsible for damage, injury, loss, or other consequences resulting from reliance upon or use of calculations, recommendations, ratios, measurements, or other information provided by JobCal PRO. Users remain responsible for independently verifying all calculations and procedures before performing work.

12. Limitation of Liability

To the maximum extent permitted by law, A&W Pressure Washing and Cleaning, its owners, officers, employees, contractors, developers, contributors, and affiliates shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Software or this License.

A&W's total aggregate liability shall not exceed the greater of (a) the amount actually paid by the user to A&W for JobCal PRO during the twelve months preceding the claim, or (b) twenty-five U.S. dollars (US $25.00). Because JobCal PRO is provided free of charge, the applicable limitation will ordinarily be US $25.00.

13. Optional Internet Features

JobCal PRO's primary calculation functionality is intended to operate offline. Optional features (feedback submission, manual update checking) may communicate with A&W-operated or third-party services when voluntarily initiated by the user. No Internet connection is required for ordinary offline use unless a particular feature expressly requires one.

14. Application Updates

A&W may periodically release updates, patches, improvements, security fixes, or new versions, without guaranteeing any particular release schedule, and may discontinue development, distribution, support, or updates for any version at any time.

15. Trademarks and Branding

JobCal PRO, A&W Pressure Washing and Cleaning, and associated logos, names, graphics, slogans, and branding may constitute trademarks or other proprietary identifiers of A&W or their respective owners. Nothing here grants permission to use this branding in a manner suggesting endorsement, sponsorship, affiliation, ownership, or authorship, or to market a modified, competing, repackaged, or derivative product.

16. User Feedback

If you voluntarily submit feedback, suggestions, bug reports, or other comments, you grant A&W permission to use that feedback to improve JobCal PRO, develop future versions, troubleshoot, document, and for internal or commercial purposes. Do not submit confidential, financial, or sensitive personal information through the optional feedback feature.

17. License Term and Termination

This License remains effective until terminated. Your rights automatically terminate if you materially violate its terms. Upon termination you must stop using JobCal PRO, delete installed copies under your control, and destroy unauthorized copies in your possession.

18. No Transfer of Ownership

Downloading or installing JobCal PRO does not transfer any ownership interest in the Software. You receive only the limited rights expressly granted under this License.

19. No Assignment

You may not assign, transfer, sublicense, or otherwise transfer your rights under this License without A&W's prior written authorization. This does not prevent permitted sharing of the original, unmodified APK under Section 5, provided the recipient independently agrees to and complies with this License.

20. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless A&W Pressure Washing and Cleaning, its owners, officers, employees, contractors, developers, contributors, and affiliates from claims, damages, liabilities, losses, costs, and expenses arising from your violation of this License, unlawful use, unauthorized modification or redistribution, misuse of calculations, violation of applicable law, or negligent or intentional acts related to your use of the Software.

21. Compliance with Law

You are responsible for using JobCal PRO in compliance with all applicable laws, regulations, safety, environmental, and chemical-handling requirements.

22. Changes to This License

A&W may update this License for future versions of JobCal PRO. A revised License may apply to future releases and distributions.

23. Severability

If any provision of this License is determined invalid, unlawful, or unenforceable, it shall be modified or limited to the minimum extent necessary to make it enforceable where legally permissible; if modification is not possible, it shall be severed without affecting the remaining provisions.

24. No Waiver

A&W's failure to enforce any provision of this License shall not constitute a waiver of its right to enforce that or any other provision in the future.

25. Entire Agreement

This License constitutes the entire agreement between you and A&W concerning your licensed use of JobCal PRO, except for separate written agreements expressly entered into between you and A&W.

26. Governing Law

This License is governed by and interpreted in accordance with the laws of the State of Tennessee, without regard to conflict-of-law principles, except where applicable federal law governs. Any legal action arising from this License or JobCal PRO shall be brought in a court of competent jurisdiction located in Tennessee, unless applicable law requires otherwise.

1. Acceptance of Terms

By downloading, installing, or using the A&W Pressure Washing Calculator application ("App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. License to Use

A&W Pressure Washing grants you a limited, non-exclusive, non-transferable, revocable license to use this App solely for professional field calculations related to pressure washing and soft wash operations. Redistribution, reverse engineering, or resale of this App or its content is prohibited without written authorization.

3. Intended Use

This App is a calculation aid intended to assist trained pressure washing professionals. Results are based on user-entered data and standard dilution formulas. The App is not a substitute for professional chemical handling training, industry certifications, or OSHA compliance requirements.

4. User Responsibilities

You are solely responsible for verifying all calculations before mixing or applying chemical solutions. You agree to use the App in compliance with all applicable federal, state, and local laws, including those governing chemical handling, environmental protection, and occupational safety.

5. Prohibited Uses

You may not use this App to generate or distribute false, misleading, or dangerous instructions. You may not use it in any manner that could cause harm to persons, property, or the environment.

6. Intellectual Property

All content, design, logic, and branding within this App are the property of A&W Pressure Washing. Unauthorized use is prohibited.

7. Modifications

A&W Pressure Washing reserves the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

8. Termination

We reserve the right to terminate your access to this App at any time for any reason, including violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of Tennessee. Any disputes shall be resolved in the courts of that jurisdiction.
